TERMS & CONDITIONS OF SERVICE – VEHICLE MOVEMENTS AND RECOVERIES - JMM TRANSPORT AND LOGISTICS (“JMM”)
These Terms & Conditions apply to all vehicle movements, collections, deliveries and recoveries, by trailer or driven under trade plates
Bookings – all instructions requesting a collection or delivery are to be provided in writing or must be confirmed in writing by the instructing party (“the Customer”) after an initial verbal instruction. Written confirmation can be sent by any electronic medium however WhatsApp is preferred. Full details of the preferred delivery date if applicable, should be provided along with vehicle details and delivery/collection address, plus contact details for any third-party recipient. Once planned, the booking will be confirmed by JMM with the Customer. The Customer should advise the vehicle recipient of the intended delivery date. JMM will contact the vehicle recipient on the day to advise of estimated time of arrival;
Cancellations/postponements – as assignments need to be planned some days in advance, once details have been agreed with JMM and the Customer, any changes to dates, times or destinations by the Customer may result in cancellation of the assignment as booked and charges may apply. For assignments involving a distance greater than 150 miles, cancellation fees may apply where less than 48 hours’ notice is provided, at the rate of £0.50 per mile. Any cancelled assignment will need to be rebooked, and a new date will be confirmed with the Customer subject to availability. Any assignment that needs to be postponed by JMM due to unforeseen circumstances will be notified to the Customer as soon as possible and rebooked at the earliest available date. Assignments that are commenced but cannot be completed eg vehicle not available/ready, or client decides not to complete purchase, shall be charged at full cost;
Pre-delivery Condition report – all vehicles are subject to visual inspection by JMM upon handover and prior to departure to record current condition. A written report is completed and supporting photographs may be taken. The purpose of this report is to record any visible exterior damage to the vehicle bodywork which exists at the handover to JMM and will identify such pre-existing items as stone chips to paintwork or glass, or dents and scratches that could potentially be attributed to JMM during transit. The report is not intended to be an exhaustive condition report and will not record paint repairs and other damage that is clearly longstanding or is unlikely to occur in transit. Should such a report be required by the client then this must be agreed at the point of booking. JMM will take all reasonable steps to ensure that any vehicle is delivered safely and in the same condition as recorded, however liability cannot be accepted for sudden, unforeseen, or unavoidable damage caused during transit such as may be reasonably expected during normal road use or by weather, unless as a direct result of negligence on the part of JMM. This includes punctures, scratches or stone chips to paintwork or windscreen damage, road grime or mud;
Loss or significant damage – JMM carries All Risks insurance cover for all vehicles under its custody. Driven vehicles are covered for their full reinstatement value, without limit; vehicles transported by trailer are subject to a maximum claim of £250,000 per vehicle (correct at time of printing). JMM accepts no liability for loss or damage costs outwith the terms of its insurance cover, unless proven to be caused as a result of negligence on the part of JMM. Should additional cover be required by the Customer then this can be arranged by JMM at the Customer’s cost;
Breakdowns under consignment – unless specifically identified as a recovery assignment at the booking stage, it is assumed that all vehicles are safe, roadworthy and in receipt of a valid MOT certificate (unless being trailered). Vehicles cannot be driven under trade plates unless an MOT is in place. Driven vehicles found not to have a valid MOT on handover will not be accepted and the assignment will be cancelled. Where such assignments involve collection and travel has been undertaken, charges will be payable in full. JMM cannot accept liability for vehicles that breakdown or fail during transit and will be under no obligation to ensure that delivery is completed for vehicles that are subject to failure or cannot be delivered safely. In the event of a breakdown occurring, JMM will immediately notify both the Customer and where applicable, the intended recipient to take instructions. If equipped and able to do so safely, JMM may agree to proceed with the onward delivery of the vehicle as a recovery, for which additional charges may be incurred;
Charges and fees – unless otherwise quoted to the Customer, vehicles transported by open trailer are charged at £1.60 per mile. Larger vehicles with a kerb weight greater than 2,000 Kg are charged at £1.85 per mile to cover additional fuel costs and increased demand on towing equipment. Vehicles transported by enclosed trailer are charged at £2.50 per mile. A quote for enclosed work can be provided to the Customer in advance upon request. Vehicles in excess of 2,000Kg that can be transported by covered trailer are charged at £2.75 per mile. Vehicles that are driven under trade plates are charged at £1.35 per mile plus cost of any fuel required. All movements are subject to a minimum charge of £85. Additional charges may apply if delivery or collection is required specifically outside normal business hours (0800 – 1800), such costs being notified to the Customer in advance. There is no additional charge for deliveries on Saturdays between 0800 - 1800. Deliveries on Sundays will incur an uplift of £0.50 per mile on the above rates. Initial quotes where given, shall be based on the shortest reasonable route subject to any restriction on trailers where applicable, however, final costs will be calculated based on the actual route taken, which may reflect traffic conditions, road closures or other factors. Costs incurred for ULEZ, congestion charges or any other road charges shall be recharged to the Customer at cost. Toll charges for tunnels and bridges will be met by JMM. Cost of fuel is recharged at the pump price. The rates quoted are for movements within the UK only. Transportation of vehicles outside the UK are quoted on request. Breakdown/recoveries (within a 25 mile radius of York) are charged at £150, increasing to £200 outside business hours plus a rate per mile as above for onward conveyance. Recoveries outside this radius quoted on request;
Invoicing and payment – invoices are usually issued on the day the assignment is completed, or within 24 hours of completion. For account holders payment terms are 7 days from the date of completion of the assignment. JMM reserves the right to impose a late payment levy of £10 per day for any invoices that are outstanding for 7 days or more, up to the date of settlement. Batch payments should be accompanied by a remittance or other form of breakdown (emailed to accounts@jmmautomotive.co.uk) showing the invoice references for payments that are included. For non-account holders, payment is due in full on completion of delivery and prior to release of the vehicle. Where charges are to be paid by a third-party recipient and not the Customer, JMM may at its discretion require payment in full in advance of delivery. The Customer remains liable to JMM for any charges and agrees to underwrite any failure on the part of a third-party recipient to settle delivery charges;
